Consignment Contract

Information:

I. Items being consigned.

A. Descriptions of items noting each item's condition (to avoid claims later).

B. Duration of the term of consignment is 30 days starting the first of the month and ending upon the 30th. Payment for rent is due upon the first of the month.

All consignors are paid for the wares on the first of the month. This is not negotiable. On this day Inventory is reviewed and payment is given to the consigner. If Consigner is paying rent, that is due on the first as well. Failure to pay rent on the first will be excused only once. If rent is not paid within seven business days, all inventory and profit is forfeit to the Pearl Heart.

Because the Pearl Heart always pays on the first, we expect our consignors to do business with us equally. If you can't make your rental payment on time you must reschedule a week before the first or you will be considered in violation of contract.

C. Vendor will set the price of the wares listed.

D. There is a twenty item limit, unless item is sold in sets. For furniture there is a ten Item limit unless you allow item for use in displays than there is no limit at all. If you would like to increase your limit than your rental fee will be raised.

II. Pearl Heart percentage fee

A. The Pearl heart will charge 20 percent commission for Items listed.

B. The Pearl Heart will charge For monthly listing fee due the first of the month.

C. The Pearl Heart will pay the vendor upon the 1st of the month a check for items sold.

III. Liability

A. The pearl Heart assumes no liability for the loss or destruction of any item.

B. A minimum of two (2) days notice must be given before pickup. OWNERS WILL BE RESPONSIBLE FOR PULLING ALL UNSOLD ITEMS.

C. All unsold items must be retrieved within two (2) weeks from the date of consignment termination or the agreement must be renewed for another 30 days. All unsold items not returned after the end of the contract period will, WITHOUT FURTHER NOTICE, automatically become property of The Pearl Heart.

Reclaiming Policies

You must receive approval from The Pearl Heart officers.

Item must be reclaimed before becoming shop property, or period specified by the Shop officers.

We do not notify consignors before items become shop property.

The Pearl Heart does not send notices to the consignor notifying them when the reclaiming period will lapse. It is the consignor’s responsibility to reclaim eligible items before the time period lapses.

IV. Consignor drop off and pick up dates

A. Consignor Drop off:

15th of the month, 2007 3-5pm

B. Consignor Pick up:

20th of the month, 2007 3-5pm

V. Sale Information

A. The Vendor will be responsible for shipping, handling, packing, insurance, and credit card charges.

B. All sales will be final and The Pearl Heart will take no responsibility for any item that is sold.

C. Items will remain the in the hands of The Pearl Heart until all payments have been satisfied.

D. The Pearl Heart will use its best efforts to promote the sale of items for consignee.

E. A statement/ picture of account or wares will be given to each consignee upon request.

Conclusion: By signing this agreement, you confirm that you have carefully read all of the guidelines and procedures explained in the consignor instructions, and agree to the terms stated above.
